Rapper YNW Melly may be facing the capital punishment after the Florida Appeals court overruled a judge’s decision in his case.
According to Billboard, Judge Andrew Siegel’s decision for prosecutors to seek death penalty has been overruled by the Florida District Court of Appeal. The ruling was made in July where it was noted that prosecutors violated state rules when Melly and attorneys were not notified up capital punishment, however, prosecutors state they did upon him being charged in 2019.
Within his upcoming trail, the decision won’t be made until Florida Supreme Court rules on the case.
Judge Spencer D. Levine has wrote a statement regarding the case, saying: “We find that the state complied with its statutory obligations when it filed its notice of intent to seek the death penalty within 45 days of arraignment. The fact that the state filed a superseding indictment, requiring a second arraignment, does not vitiate the already filed and timely notice of intent. The defendant has had nearly three years to start the preparation of his defense to the state seeking the death penalty [,] the record contains no evidence that the defendant was prejudiced in any way.”
YNW Melly along with friend YNW Bortlen were arrested in February 2019 where they were ultimately charged with two counts of first-degree murder of their friends YNW Juvy and YNW Sakchaser in October 2018.
